Terms and Conditions – Flooring Supply and Fit

1. Definitions

  • “Company” means Jacofloor Ltd trading as Aztec Carpets & Flooring, the supplier and installer of flooring products.
  • “Customer” means the individual or company who purchases goods and/or services from the Company.
  • “Goods” means the flooring materials supplied.
  • “Services” means the fitting or installation of flooring materials.

2. Estimates and orders

  • All estimates are valid for the period stated on the written estimate. After this time prices would be revised.
  • Any queries regarding quantities of materials, method of fitting, positions of joins etc. must be raised prior to acceptance of the estimate.
  • A written confirmation or deposit payment from the Customer constitutes acceptance of the estimate and these Terms and Conditions.
  • The Company reserves the right to revise prices if the Customer makes changes after acceptance.

3. Payment terms

  • A deposit of 50% is required to secure materials and schedule installation.
  • Final payment is due upon completion of the work unless otherwise agreed in writing in advance.
  • Late payments may incur interest at a rate of 3% per month.
  • If the final balance isn’t paid after reminders and attempts to get in contact the Company will commence small claims court proceedings.
  • The Company does not offer payment plans

4. Delivery and installation

  • Delivery dates are estimates only and may be subject to change due to supplier delays or unforeseen circumstances.
  • The customer must ensure clear and safe access to the work are on the agreed installation date. Failure to do so could result in delays to installation and additional charges.
  • The Company is not liable for delays caused by the Customer or third parties.
  • Fitters undertake to carry out their work with reasonable skill and care but even with the greatest care home décor may be marked or scuffed during the fitting process. New paintwork or wall paper is especially vulnerable. The Company does not undertake to carry out or pay for any redecoration unless the damage has been caused by the fitters negligence.

5. Subfloor Preparation

  • The quotation assumes the subfloor is suitable for installation unless otherwise stated.
  • Any additional work required (e.g. levelling, damp proofing or repairs) will be charged separately.
  • The Company will notify the Customer if additional work is required and seek approval before proceeding.

6. Customer Responsibilities

  • The Customer must remove all furniture and appliances from the installation area unless prior arrangements are made. Failure to do so could result in delays to the installation and further charges.
  • The Customer must ensure electricity and water are available on-site for the duration of the works unless prior notice has been given and an agreement made.
  • The Customer must keep the Company informed of any changes that may delay the planned installation.

7. Warranties

  • The Company provides a workmanship guarantee which matches that of the product manufacturer. This activates upon receipt of payment of the final balance for works.
  • Manufacturer warranties on flooring products apply as per their terms and conditions details of which are available on request.
  • The guarantee and warranties do not cover damage caused by misuse, negligence or failure to follow care instructions.

8. Cancellations and Refunds

  • Orders cancelled more than 10 days before the installation date may be refunded minus any non-refundable supplier charges.
  • Orders cancelled within 10 days may incur cancellation fees.
  • Custom or special-order materials are non-refundable once ordered.

9. Liability

  • The Company is not liable for any indirect, special or consequential loss or damage.
  • Liability for faulty workmanship is limited to the cost of rectifying the issue.
  • The Company is not responsible for damage to cables, pipes or other hidden services unless clearly marked or disclosed.

10. Dispute resolution

  • Any disputes should be reported in writing within 7 days of discovery.
  • The Company will make reasonable efforts to resolve disputes amicably and swiftly.
  • If unresolved, disputes may be referred to mediation or small claims court.

11. Force Majeure

  • The Company shall not be held liable for any failure or delay due to circumstances beyond its control, including but not limited to, natural disasters, supplier delays or pandemics.

12. Governing Law

  • These Terms & Conditions are governed by the laws of Great Britain.
  • Any legal proceedings shall be conducted in the courts of Great Britain.

13. Acceptance

By placing an order and/or paying a deposit, the Customer confirms they have read, understood and accepted these Terms & Conditions.
